Terms of service

Last updated: [date]

Draft: to be reviewed by a solicitor before SnagBook is offered for sale. Items in [square brackets] still need filling in.

1. Who we are

SnagBook is provided by FixMyPool Ltd, trading as SnagBook (company number 17061006), whose registered office is at 19 William Street, Colne, Lancashire, BB8 0HH ("we", "us"). You can contact us at hello@snagbook.co.uk.

2. These terms

These terms apply between us and the business that signs up for SnagBook ("you"). By creating an account or using SnagBook you agree to them on behalf of that business. SnagBook is for business use only and not for consumers.

3. Your account

You're responsible for the people you give access to, for keeping logins secure and for everything done under your account. Tell us straight away if you think your account has been accessed without permission.

4. Free trial

New accounts get every feature free for 30 days. At the end of the trial you can choose a paid plan; if you don't, your account moves to the Free plan and features outside it are locked. Nothing you've added is deleted. The Free plan has the limits shown on our pricing page.

5. Fees and payment

Paid plans are charged in advance, monthly or yearly, at the prices shown on our pricing page when you subscribe. Prices exclude VAT. If a payment fails, we'll let you know, and we may suspend access if it isn't sorted out within 14 days. We'll give you at least 30 days' notice of any price change, which will apply from your next billing period.

6. Cancelling

You can cancel at any time. Your plan stays active until the end of the period you've paid for, and we don't give refunds for part periods unless the law requires it.

7. Acceptable use

Don't use SnagBook to break the law, to upload anything you don't have the right to share, to try to get at other customers' data, or to interfere with the service. We may suspend accounts that do.

8. Your data

The records, photos and files you put into SnagBook ("your data") belong to you. You give us permission to store and process your data only so we can provide SnagBook to you. Where your data includes personal information, we process it on your behalf under our privacy policy and our data processing terms [link to DPA].

You're responsible for the accuracy of your data and for meeting your own legal duties, including health and safety and compliance obligations. SnagBook helps you keep track; it doesn't replace professional advice or inspections.

9. Exporting and deleting data

You can export your data from Settings at any time. If your account closes, we'll keep your data for 30 days so you can export it or change your mind, then delete it, except where we must keep something by law. Backups are overwritten within a further [number] days.

10. Availability and changes

We aim to keep SnagBook available at all times but can't promise it will never be interrupted, for example during maintenance. We improve SnagBook regularly and may change features; we won't remove a core feature you're paying for without reasonable notice.

11. Our liability

Nothing in these terms limits liability that can't be limited by law, such as for death or personal injury caused by negligence, or for fraud. Otherwise, we're not liable for indirect or consequential losses, or for loss of profit, revenue or data beyond our obligation to restore from backups. Our total liability in any 12 months is limited to the fees you paid us in that period.

12. Ending these terms

Either of us may end these terms if the other seriously breaks them and doesn't put it right within 14 days of being asked. We may also end them on 30 days' notice if we stop providing SnagBook, and refund any fees you've paid for time after that.

13. General

We may update these terms and will tell you about material changes at least 30 days in advance. These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
